Parents held responsible for underage drinking

(AP) ? Parents of teens: If you think a drinking disaster at your kid's party can't happen at your house, not with your kid, because he's a good kid, it's time to wake up and smell the whiskey bottle tossed on your lawn.

Because of the high risk of underage drinking and driving this time of year, many parents open their homes to partying teens as a way to keep them off the roads. What some may not know is that liability laws can leave Mom and Dad vulnerable to lawsuits, fines and even jail time if underage drinking is found to be going on under their roof.

Parents can get in trouble even if they didn't know about the drinking.

That's what a Menlo Park, Calif., father says he is up against.

Bill Burnett, a Stanford University professor, was arrested the night after Thanksgiving over a basement party thrown by his 17-year-old son to celebrate a big high school football win.

Burnett said he and his wife had forbidden alcohol at the party and were upstairs at the time police received a call about possible drinking by minors. In fact, he said, he had twice made his way to the basement to check on the merry-making.

He spent a night in jail and was booked on 44 counts of suspicion of contributing to the delinquency of a minor. Each misdemeanor count carries up to a $2,500 fine and nearly a year in jail.

Burnett questioned the deterrent value of laws that hold parents legally responsible even if they didn't know there was alcohol at the party.

"In this case I think arresting a parent isn't going to prevent kids from drinking," he said on the "Today" show.

Eight states have specific "social host" laws that say parents can get in trouble if underage guests are drinking, even if no one gets hurt, according to the National Institutes of Health. (Some of those states allow parents to serve alcohol to their own children in some situations.)

Sixteen other states have laws that hold Mom and Dad legally responsible for underage drinking under certain circumstances ? for example, if a teen who drank at their home got into a car accident, NIH said. In other states, parents can get in trouble under more general liability laws.

Stephen Wallace, a senior adviser at Students Against Destructive Decisions, or SADD, which used to be called Students Against Drunk Driving, said that with an increased awareness of the dangers of underage drinking, law enforcement authorities are increasingly relying on social host liability laws to go after parents.

While he acknowledged that teens are adept at finding ways to drink on the sly, he said he is all for anything that gets at the problem of underage drinking. He said he finds it troubling that the Burnetts said they saw no alcohol consumed at their party.

"Parents need to say to kids, 'You shouldn't be drinking at all and you certainly can't do it here because we can be put in jail,'" Wallace said.

According to SADD research co-sponsored by the insurance company Liberty Mutual, more teens are saying that their parents allow them to go to parties where alcohol is being served ? 41 percent in 2011, compared with 36 percent two years ago. Also, 57 percent of high school students whose parents allow them to drink at home said they prefer to drink elsewhere with their friends, Wallace said.

At some parties, the parents themselves supply the booze. In other cases, the kids bring it, sometimes with the hosts' knowledge.

"Some parents feel helpless," said David Singer of Demarest, N.J., who has 17-year-old twin daughters and a 20-year-old son in college. "Some parents feel they need to look the other way in order to help their kids fit in with the cool crowd. And some parents believe, 'It's better under my roof than who-knows-where.'"

Like Burnett, Singer said he doesn't condone drinking by his underage kids under any circumstances. And yet he found a whiskey bottle in the yard after a party thrown by his son.

Burnett acknowledged he made a mistake but said he doesn't believe police crackdowns like the one at his house do much good.

"All of this is probably going to go underground and result in a more dangerous situation for kids," he told the online news network Patch. "I really don't think it's up to the police to help me parent."

Your momma always said your handsome mug would take you places. Now it might allow you to access your iPad. An Apple patent application released today describes a facial recognition system that requires minimal computing power, and works whether you're indoors or out -- we don't use our tablets and phones in a photo booth, after all. The technology works by comparing a current image of your mug to a reference model user profile made using "high information" portions of the human face, like eyes and mouths. Translation: it'll take a picture, compare it against the pictures associated with various user accounts on the device and decide if the two images are similar enough to grant you access. Because this is just an application, it's safe to say we won't be seeing this kind of facial recognition in iOS anytime soon, but let's hope it works better than the ICS version if it does.

Update: An important thing to note is that Apple applied for this patent long before Android's Face Unlock debuted a few months back. The paper work was first submitted on June 29th, 2010 -- it's just now being disclosed to the public.

Autopsies: Conn. victims died of smoke inhalation (AP)

STAMFORD, Conn. ? Five family members who were killed in a Christmas morning house fire in Stamford died of smoke inhalation, the Connecticut medical examiner said Wednesday.

One of the victims, Lomer Johnson, also suffered a blunt head and neck injury, which could have resulted from a fall or being hit by an object, according to the medical examiner's office.

The other four victims were Johnson's wife, Pauline, and three of their granddaughters, 10-year-old Lily and 7-year-old twins Grace and Sarah.

All the deaths were ruled accidental. Stamford fire officials said Tuesday that embers in a bag of discarded fireplace ashes started the fire.

Homeowner Madonna Badger, an advertising executive who is the girls' mother and the Johnsons' daughter, escaped from the fire, as did Michael Borcina, a friend and contractor working on the house. Borcina, 52, was released from Stamford Hospital on Wednesday morning, a spokeswoman said.

As flames shot from the home, Badger climbed out a window onto scaffolding, screaming for her children and pointing to the third floor.

Firefighters went into the house twice trying to rescue the victims, but were forced out by the blaze's intensity. Four firefighters were injured, including a captain who suffered second-degree burns on his face, officials said.

Borcina and Johnson tried to save them, as well. One of the girls, found dead just inside a window, had been placed on a pile of books, apparently so Johnson could reach in and grab her after he jumped out.

Instead, authorities say, Johnson fell through the roof outside the window and was found dead in the rear of the house.

He and his wife, both of Southbury, had been visiting their daughter for the holidays.

Sony Ericsson have been releasing quite a bit of smartphones in the past few weeks and considering they have decided to focus only on smartphones from now on, it makes sense to fill the market with a phone or two for every category and niche. The Xperia Active reminds me of a bar of soap with a handle. As much as I tried to describe how it looks, I kept going back to that. This is not to say that it?s not elegant or looks ugly but it certainly isn?t your typical smartphone. I guess that?s a given considering not only the fact that it?s water resistant but that its name suggests it?s meant for much more. The Xperia Active takes a lot of its looks from the Xperia Mini, and it?s a good design for the purpose it serves.

The 3-inch screen is surrounded by a metallic band with the words ?Xperia? inscribed at the bottom near the lanyard holder. At first I wondered if the holder could also serve as a bottle opener, the phone sure looks sturdy enough to open a few bottles in an emergency. The phone?s physical buttons are orange in color which adds to the sporty theme Sony Ericsson tried to get going here. I had an issue with the power/unlock button that?s on the left side of the phone. Unlike the volume and camera buttons on the other side, the power button doesn?t protrude as much and I found it hard to use. It wasn?t like there were times when I couldn?t press the button but after about a week of using the phone I still don?t like the power button. At the back of the phone you have the loudspeaker next to the camera lens and above that is the flash and the secondary mic. The USB and 3.5mm audio connector are at the bottom near the lanyard holder. They?re covered to ensure the phone is completely water resistant should it come into contact with water. In fact if you disconnect the earphones and check the screen it often reminds you to recover the connector to keep the phone water resistant.

On the front there is no secondary camera for video calls which seems a little odd considering this phone pretty much has everything else squeezed into it. It comes with a proximity sensor next to the speaker as well as a small led for notifications. At the bottom of the screen you get capacitive buttons for Back, Home and Menu and a mic. The build quality is excellent as you should expect from a phone that can survive a drop in water and it certainly looks like it can survive a drop on the floor as well within a reasonable height. To access the sim card, battery and microSD slot you have to remove two covers. The second cover is under the first and acts as an insulator to protect the internals from the elements.

Included in the box is a microUSB cable, charger, earphones with mic and call/end button, ear hooks, manuals, wrist strap and an armband. A microSD card might also be in the retail package but my review phone did not come with one nor did it come with the ear hooks, wrist strap or the armband. The Xperia Active has a 3 inch screen with a resolution of 320 x 480 which is pretty impressive for its size. Thanks to the Reality display and the Bravia mobile engine, pictures are crisp and clear on the screen. Despite its size this phone is no slouch, it?s running on a 1 GHz Scorpion CPU with the Adreno 205 for graphics. It also has 512MB of RAM and 1GB built-in storage but only about 320MB will be usable. The 5 megapixel camera has autofocus and image stabilization and can take videos at 720p. GPS, WiFi and DLNA are also included so this phone by no means is a ?budget? Android phone, Sony Ericsson have included virtually all the bells and whistles on this one. When I installed the PC software for it I was prompted to update my phone so I ended up running Gingerbread 2.3.4 which while not the latest comes with several improvements such as a 3D panoramic camera options and swipe with T9. ?Using SunSpider I was able to get 3424.8ms which is on par with the Xperia Pro that had similar internals but trails behind the Arc S and its upgraded CPU?s score of 2607ms.

Students claim L-3 falsely promised FAA jobs

Arlington-based Link Simulation and Training Air Traffic Control Academy used false promises of jobs with the Federal Aviation Administration?

Thirteen men claim L-3 Communications charged them $41,000 apiece in tuition and guaranteed them that "the first 100 graduates would be hired by the FAA," according to the suit. L-3 provided inadequate training and they never got the jobs, according to the claim filed in federal court in Dallas.

"To date, not a single student has received a job offer as promised," the lawsuit says. "In fact, plaintiffs have learned that the FAA never made the agreement represented by the defendants."

"Furthermore, plaintiffs have learned that their training received at the Academy is insufficient, by itself, to even qualify them to work in a FAA air traffic control tower," the complaint says.

A spokesperson for L-3 could not immediately be reached for comment.

The plaintiffs say L-3 told them that the company had reached an agreement with the FAA to hire the first 100 Academy graduates, that graduation from the academy would qualify them for employment in a FAA air traffic control tower and that graduates would be employed by the FAA before they had to repay loaned tuition.

Saudi firm buys farmland in Argentina to secure animal feed

DUBAI, United Arab Emirates ? Saudi Arabia's largest dairy company said this week that it is buying Argentine farm operator Fondomonte for $83 million to secure access to a supply of animal feed.

The acquisition will give Riyadh-based Almarai Co. control of roughly 30,000 acres of farmland in the South American nation just ahead of tough new limits likely to be imposed by Argentina's government on foreign ownership of productive land.

Almarai said the deal is in line with the desert kingdom's policy of "securing supplies and conserving local resources."

Despite its scorching desert climate, Saudi Arabia for decades produced millions of tons of homegrown wheat with the help of generous farm subsidies. It is now trying to wind down domestic production because of concern over dwindling water supplies.

Fondomonte operates three farms in Argentina dedicated to producing corn and soybeans, according to Almarai. The Argentine company's website says it also grows barley, rice and sorghum.

Almarai said it plans to use the crops to feed chickens and cattle.

"This is a relatively significant move, that they're actually acquiring a company," said Farouk Miah, an analyst at NCB Capital in Riyadh. "If anything, I think this is the beginning of a trend."

The Saudi purchase was announced as Argentina's Senate prepared to approve strict new limits on foreign land ownership, designed to protect the South American country's food resources.

The law, proposed by President Cristina Fernandez and already passed by the House, would limit individual foreign ownership of rural land to 2,500 acres per titleholder, and bar any more purchases by foreigners once 15% of Argentina's land is foreign owned.

No one knows just how much Argentine land is already in foreign hands. The law would create a nationwide land registry to establish who owns what. Fernandez has said the law would not take away land already owned by foreigners.

As their populations boom, oil-rich Gulf Arab nations have shown increased interest in buying farmland and other agricultural assets overseas to ensure reliable food supplies.

Emirati investors have bought farmland in Pakistan, while Saudi Arabia's Binladin Group has sought to develop rice fields in Indonesia. Qatar's sovereign wealth fund set up a company in 2008 known as Hassad Food specifically to target agricultural investments abroad.

Almarai is one of the Middle East's largest food companies. It traditionally focused on milk and other dairy products like yoghurt and cheese, but it has recently begun expanding into new product lines such as juices, baked goods and poultry products.

That expansion means "it's even more critical for them to have secure supplies coming in," Miah said.

Why Microsoft wants to kill netbooks?


Last week one of the major business-oriented computer manufacturers, Dell announced that it would no longer produce netbooks. The company will be still selling a couple of Latitude business models, but it's not going to develop new netbooks on the upcoming Intel Cedar Trail platform. Obviously, Dell was not happy with netbook sales. And other netbook manufacturers are also having problems. According to ABI Research, netbook sales in Q2 of this year fell to 7.3 million from 13.6 million in the Q1. At the same time, the sales of the competing technology - tablets during the same period grew from 6.4 million to 8.4 million. But tablets aren't the main reason of the netbooks problem. The main reason is Microsoft.

Microsoft didn't like netbooks from the very beginning. Because the idea of netbook is "Cheap, small, low-power laptop for working in the Internet". The Windows operating system appeared to be excessive for netbooks. Everything was ok with Windows XP, but Vista for the device in which the main application - it browser, was not good at all. And the market price of netbooks ($200-300) can't include $100 for Windows license. Microsoft had to sell Windows licenses to OEMs with big discount. And it's losing money each time when a customer chose a cheap netbook instead of a full-featured laptop.

In Windows 7 Microsoft introduced a number of limitations. First, the stripped version of the OS for netbooks Windows 7 Starter could only be installed on netbooks with smaller than 10.1 inch screen and less than 1GB of memory. Second, Windows 7 Starter lacks some important for business features - Windows Server support, encryption, support for workgroups. While business users - are probably the main buyers of netbooks.

As a result, there almost no good Windows-netbooks on the market. But buyers still want the cheap Windows-netbooks.

Another case with tablets. They cost from $600 and people buy them mostly because of apps, but not because of browser. This niche is more interesting for Microsoft. That's why the new Windows 8 is positioned as an OS for tablets.

The last hope for netbooks - is Google, with its Chromebooks and Chinese manufacturers, that love to produce cheap devices.

The morning of the wedding, as I was getting ready with all the girls in the hotel room, we got a knock on the door. It was Dave?s brothers and they had a gift for me that they brought that was from Dave & Dave?s family. Dave?s mom, Lucy, had a cross necklace made for me as a wedding gift; it was a replica of a cross necklace, that she has had in her family for years. It was so special to her to be able to pass this on to the her ?new daughter? as a way to welcome me to their family. It was a gold cross with pearls and a green precious stone in the middle. It was so special to me to be given something so beautiful and something that has such meaning. Unbeknownst to Lucy, I had borrowed a vintage family bracelet and earrings from my grandmother to wear for the wedding. Pearl earrings and a vintage green emerald bracelet. When I paired all three together and put them all on with my dress, the combo of all three was perfect. It meant the world to me to be wearing such beautiful pieces that came from both my family and my new family.

Walking down the aisle with my dad was another one of my favorite moments. My parent?s toast to us was also incredible. Having been married for 35 years, they gave us words of wisdom, advice and told such great stories. Every guest came up to my parents to thank them that night and that meant so much to us.

Once we met with our florist Kim, from Toast Santa Barbara and we chose all of our white flowers (hydrangeas, garden & polo roses, anemones, white veronica, etc. , we realized that we could save a lot of money by providing our own flower containers. We began collecting all of our flower containers? vintage mason jars, vintage milk bottles, small glass jam jars (peeled labels off), french lemonade bottles from Trader Joes, Starbucks Frappuccino bottles (labels off)? literally anything in a glass jar that I found in my kitchen, I examined to see if I could use it as a flower jar?When it all came together on our long banquet tables, I really loved the look of all the different shapes and sizes of the glass bottles as our floral centerpieces. Such an easy way to save some money & create a vintage look for less.

For the ceremony aisle (and along the entire length of the grape pergola) we envisioned hanging mason jars hung with twine filled with white flowers, succulents and greenery next to hanging jars with lit candles. We rented 2 wine barrels to be the focal point at the end of the aisle and covered them with a lush spread of hydrangeas, succulents and candles.

DANCING! Our band and our DJ were INSANE. They played back and forth all night long. The best thing you could ever wish for when throwing a great party, is that the dance floor never be empty. The dance floor was never NOT FULL.

Chinese boat captains arrested in Japan waters

Japan's coast guard says it has arrested two Chinese boat skippers in separate cases of suspected illegal fishing in Japanese waters.

Officials say a 39-year-old skipper was arrested Tuesday for alleged coral poaching off the Goto islands near Kyushu.

They say the second skipper was arrested Wednesday near the Ogasawara islands, 600 miles (1,000 kilometers) south of Tokyo. They said Thursday that both allegedly ignored calls to stop for inspection, prompting a chase.

If convicted, the skippers could face up to six months in jail or a fine of up to 300,000 yen ($3,840).

The incidents aren't likely to spark disputes as they didn't occur in contested waters.

Officials say Chinese poaching in and around Japan is on the rise.

(AP) ? Why do kids believe a chubby guy in a flying sleigh can deliver joy across America? Because their parents do. A whopping 84 percent of grown-ups were once children who trusted in Santa's magic, and lots cling to it still.

Things are changing fast these days, with toddlers wishing for iPads, grade schoolers emailing their Christmas lists and moms wrestling over bargain toys at midnight sales. Despite all the pressures on the rituals of the season, an AP-GfK poll confirms that families are sticking by old St. Nick.

"It's important for kids to have something to believe in," says great-grandmother Wanda Smith of Norman, Okla.

And so they do. Year after year, Santa Claus survives the scoffers and the Scrooges and the 6-year-old playground skeptics. He endures belittling commercials that portray him shopping at Target or taking directions from an iPhone. He shrugs off scolds who say his bagful of toys overshadows the reason for the season.

Two-thirds of parents with kids under 18 say Santa's an important part of their celebrations this year. Moms, especially, have a soft spot for the man in red ? 71 percent of them say he's important, and that's a big jump from 58 percent just five years ago.

His overall popularity is up slightly from an AP-AOL poll in 2006, before the recession hit. In these bleaker times of homes lost to foreclosure and parents sweating out their next paychecks, the poll shows Santa riding high with families both wealthy and poor.

Maybe that's because the big guy's always known how to stretch a dollar to make a kid smile.

Smith, whose childhood gifts were mostly handmade by her mother ? things like cookies and knit scarves ? remembers that every year Santa Claus managed to put one present under the tree for her to share with her two brothers (four more siblings came later).

"One year it was a bicycle, one year we had a sled. One year we got a puppy ? his name was Jack and he was a border collie," recalls Smith, now 70.

"We didn't have a lot," she said, "but we didn't know it. Our mother and daddy made it a wonderful time for us."

In multicultural America, Father Christmas isn't just for Christians any more. Three-fourths of non-Christian adults say they believed in Santa when they were children. And half feel he's important to their holiday celebrations now.

Developmental psychologist Cyndy Scheibe, who's been interviewing kids about Santa since 1986, said lots of Jewish children told her that Santa Claus was real, even though he didn't stop at their houses on Christmas Eve.

And many non-Christian parents embrace Santa because they see Christmas serving as a secular as well as religious holiday in the U.S., she said.

"Santa Claus is more than someone who just comes and gives you a present, it's this whole spirit of giving and magic that you get to be a part of and celebrate," said Scheibe, an associate professor at Ithaca College in New York.

That's what keeps Santa going over the decades and across cultures, she said. "That, and there's almost nothing as much fun as getting to see your kid's face so completely excited."

Scheibe knows firsthand. She used to climb a ladder to the roof every Christmas, her daughter watching, to leave a key tied to a big red bow, because they didn't have a fireplace.

It's not all snowflakes and mistletoe in Santaland, however. Even among Christians, there's tension about how big a role, if any, a jolly old elf deserves in the celebration of Christ's birth.

Almost half of Americans polled said Santa detracts from the religious significance of Christmas more than he enhances it.

When she was growing up, Naomi Stenberg's fundamentalist Baptist parents didn't want her mixed up with Santa Claus or the Easter Bunny or Halloween trick-or-treating.

"I didn't understand why everybody else got to believe in Santa, and me and my brother didn't," says Stenberg, 32, now a stay-at-home mom in Baxter, Minn. "I felt left out."

Her own three children have gotten the full Kris Kringle experience, but sometimes she feels ill-equipped to handle the tough queries from her youngest, 6-year-old Rylen.

"She's been asking questions like how does Santa fit through the chimney," she said. "I don't know how to answer things like that."

Matt Hoyt vividly remembers seeing Santa's black boots peeking out from behind his bedroom curtains when he was a boy. He froze. "I was just trying to pretend to be asleep," Hoyt said, "so I'd get my presents."

Only much later did he realize those were probably the black shoes of his dad, hanging his new "Star Wars" drapes. Now Hoyt, a 35-year-old computer engineer from Houston, is awaiting the birth of his first child in April, and wondering how long that child will believe.

In the poll, the median age when adults said they outgrew Santa was 8. Hoyt suspects his child's generation will turn away even earlier. After all, "They've got Google at their fingertips."

But Santa needn't worry. They'll come back someday ... when they're parents.

The Associated Press-GfK Poll was conducted Dec. 8-12 by GfK Roper Public Affairs and Corporate Communications. It involved landline and cellphone interviews with 1,000 adults nationwide and has a margin of sampling error of plus or minus 4 percentage points.

Department Lessens Gun Sale Restrictions for Legal Aliens

The Department of Justice has decided to ease restrictions on gun purchases for legal non-residents, according to an open letter posted on the Bureau of Alcohol, Tobacco, Firearms and Explosives website.

The?letter, written by ATF?s Firearms and Explosives Industry Division Chief?Chad J. Yoder, states that the department recently concluded that ?applying a more stringent State residency requirement for aliens legally present in the U.S. than for U.S. citizens is incompatible with the language of the [Gun Control Act.]?

The Gun Control Act prohibits licensed merchants from selling firearms to any unlicensed person who they know, or have reason to believe, does not reside in the seller?s state, according to the letter. ?Writing to federal firearm licensees, Yoder says that licensed merchants must have documentation verifying that a legal non-resident has lived in the state?continuously?for at least 90 days before selling any firearms according to the current law.

With the department?s recent decision, ATF will revise the regulations and remove the separate 90-day residency requirement for legal non-residents, the letter states. ?Once these changes have been made, U.S. citizens and legal non-residents will face the same requirements for proof of residency.

Until ATF can make these amendments, the current regulations remains in place, Yoder writes. ?He did not provide a timeline for completion in the letter.

Update 5:45 p.m.: A Justice Department?spokesperson?said this does not expand any rules under the Gun Control Act, it merely removes a previous stipulation for legal aliens. ?Those who fall under the category of legal alien will still have to go through the same process as an American citizen does to purchase a firearm, showing proof of residency, among other things, the spokesperson said. The spokesperson could not specify when this decision was made, but said that the department regularly conducts legal reviews of these rules and such reviews occur on an ongoing basis.

Editor ousted over racial slur against Rihanna

(AP) ? The editor of a Dutch fashion magazine has been fired after the publication used a racial slur to refer to Barbados-born Rihanna, setting off a social media furor and prompting an outraged response from the singer.

Eva Hoeke, editor of "Jackie," and the magazine's publisher said in a joint statement on Facebook that the misuse of a racial slur ? "although without malicious intentions" ? was cause for Hoeke's departure after eight years on the job.

The slur was used in an article about how to dress your daughter like a pop star. Responding to criticism that flashed across the ocean, Hoeke said at first that her use of the term was meant as a joke.

She then put out a Twitter item with a more explicit apology, saying she learned, "1. Don't publish bad jokes in the magazine 2. Don't pretend bad jokes to be funny. Sorry guys. My bad."

On Tuesday, Rihanna responded herself via Twitter: "Your magazine is a poor representation of the evolution of human rights! I find you disrespectful, and rather desperate!!"

Rather than a positive article useful to Dutch girls, Rihanna said Jackie chose to print an item "degrading to an entire race. That's your contribution to this world!" She also ended her tweet with an indelicate phrase.

Hoeke said she was unaware the word she used was so loaded because "you hear it all the time on radio and TV."

By Wednesday, the Facebook apology had attracted hundreds of comments, many condemning Hoeke but some saying the reaction was overblown.

Warren Hellman Dead: Beloved San Francisco Financier And Philanthropist Dies At 77

Warren Hellman, San Francisco's beloved, banjo-picking billionaire, died Sunday night after a long battle with leukemia. He was 77.

A local legend, Hellman was best known as the founder and force behind the Hardly Strictly Bluegrass festival, the weekend of free music -- completely funded by the financier -- that takes over Golden Gate Park each autumn and draws big-name acts ranging from Emmylou Harris to Broken Social Scene.

But Hellman's legacy extends far deeper into the fabric of the city than the three days of joy he sponsored each September in the park. He spent his life giving to the causes he cared most deeply about.

Since building his fortune in finance, first as the youngest partner in the now-defunct Lehman Brothers investment bank's history (at age 28) and later as co-founder of the private equity firm Hellman & Friedman, Hellman donated almost everything he had to his passion projects and political causes throughout San Francisco. According to the San Francisco Chronicle, the investor often joked that he had little interest in collecting expensive cars or art.

"What does move me is the philanthropic stuff," he told Forbes magazine in 2006. "Giving really does move me."

In addition to creating and maintaining one of the city's most cherished festivals, Hellman funded the San Francisco Free Clinic, built an underground parking garage in Golden Gate Park to help keep the DeYoung Museum intact after the 1989 Loma Prieta earthquake, spearheaded a major pension reform effort during the November elections and co-founded online local news website The Bay Citizen.

"Warren was San Francisco, and his passion for the city ran deep," longtime friend Phil Bronstein, the former Chronicle editor, told The Bay Citizen. "His philanthropy and quiet leadership were unparalleled.?

And San Francisco recently had a chance to show its gratitude. Last Thursday, the city's Recreation and Parks Commission unanimously voted to rename Golden Gate Park's Speedway Meadow, the nucleus of Hardly Strictly, to "Hellman Hollow." ?I can?t think of another citizen of San Francisco that has done more for the city or had the City as his highest priority on almost everything he has ever done,? Mark Buell, chairman of the commission, told the San Francisco Examiner.

A budding banjo player himself, Hellman performed at nearly every iteration of Hardly Strictly with his band, The Wronglers, writing songs about the various causes and issues that made him tick. Unconventional to the core, the lifelong Republican supported labor unions, was known for his rugged, frayed wardrobe and attended Burning Man the year he turned 70.

He even postponed chemotherapy treatments in order to appear onstage with The Wronglers during this year's Hardly Strictly festival. Good-spirited until the very end, Hellman would more recently joke that he had changed his name to Luke Emia, according to The Bay Citizen.

And festival fans need not fret: Hardly Strictly will continue in Hellman's wake for many years to come. The financier created an endowment fund for the explicit purpose of funding the event "after I croak." "Yes, the Hardly Strictly Bluegrass festival will go on!" his daughter, Patricia Hellman Gibbs, confirmed to the Chronicle on Sunday.

Public services will be held in Hellman's honor on Wednesday at San Francisco's Congregation Emanu-El. According to his family, a community celebration of his life will take place in the following weeks. The family has requested that instead of sending flowers, mourners pay their respects by making donations to the San Francisco Free Clinic, The Bay Citizen, and the San Francisco School Alliance.

Bond set at $100,000 for Bears player Hurd

CHICAGO (AP) ? The attorney for Sam Hurd said Friday that his client had never sold drugs to other NFL players, hoping to put any rumors to rest as the wide receiver without a team prepares to fight federal drug charges that could put him in jail for 40 years.

Less than an hour after Hurd was cut by the Chicago Bears, defense attorney Brett Greenfield told reporters that his client planned to fight the charges and wanted one thing made clear.

"Sam has asked me to address one point, with respect to the rumors that Sam has been supplying drugs to other members of the NFL, out of respect to the NFL, out of respect to teammates and out of respect to other players, he 100 percent denies that allegation," Greenfield said. "It is patently and totally false. It just didn't happen."

League spokesman Brian McCarthy said the NFL was closely monitoring the situation. Asked about a report that authorities have a list of NFL players with ties to the drug case, McCarthy said: "We are not aware of such a list."

U.S. Magistrate Young Kim ordered Hurd to surrender his passport and any firearms. Hurd is expected to be tried in Texas, where the criminal complaint was filed this week by the U.S. attorney.

Hurd, who appeared in court in an orange jumpsuit with his feet shackled, waived his right to a preliminary hearing, meaning the next step is for prosecutors to take their case before a grand jury. Several members of Hurd's family, including his wife, mother and brother, attended the hearing but he didn't appear to look at them, even as he was led out of the room. He was later released after posting $100,000 bond.

Hurd was arrested Wednesday night outside a Chicago steakhouse, according to the complaint. He allegedly told an undercover agent he was interested in buying five to 10 kilograms of cocaine and 1,000 pounds of marijuana per week to distribute in the Chicago area.

Hurd told the agent a "co-conspirator is in charge of doing the majority of the deals" while he focused on "higher-end deals," the complaint said. He agreed to pay $25,000 for each kilogram of cocaine and $450 a pound for the marijuana, according to the charges, and then said he could pay for a kilo of cocaine ? about 2.2 pounds ? after "he gets out of practice." He walked out of the restaurant with the package and was arrested.

Hurd faces up to 40 years in prison and a $2 million fine if convicted of conspiracy to possess with the intent to distribute more than 500 grams of cocaine, or half a kilogram.

Teammates said they were stunned by the allegations and general manager Jerry Angelo said he was, too, as he announced the team was cutting Hurd.

"There were no facts, there were no flags, that anybody could present tangibly to say we should have known otherwise, and I want to make that perfectly clear to the public, to our fans," Angelo said Friday. "We do our homework. We do our due diligence. We did everything you could possibly do given the information that we can allocate."

The 26-year-old Hurd was in his first year with the Bears and sixth year overall in the NFL after five years with the Cowboys. Angelo said the Bears performed an extensive background check on Hurd, a San Antonio native who played at Northern Illinois, before signing him in July to a three-year deal reportedly worth up to $5.15 million, including a $1.35 million signing bonus and base pay this season of $685,000.

"We go back, we ask questions," Angelo said. "Is there something we could have done, something we should have done, in the process? Sometimes, there are glitches, but in this case, there are none. I could sit here and tell you with total transparency that we did everything we know to do in terms of our research, and there was nothing that we found that would create a flag or an alert or a real concern in Sam Hurd's case."

Asked how certain he was that other players on the Bears or around the league were not involved, Angelo said, "I can't talk about that."

"I'm certainly not going on any witch hunts about players," he added. "The one thing that we've done when there's been a wrong, we've acted. We don't justify wrongs. We've acted. We have a track record of doing that. Unfortunately, a situation arose that caught us off guard, but not to the point where we aren't going to do the right thing."

The Bears announced their contract agreement with Hurd on July 29, one day after federal authorities say he had agreed to a "consensual interview" with Homeland Security investigators over $88,000 in cash that had been seized in a car he owned in the Dallas area. The money was inside a canvas bag that authorities said was covered in a plant-like material that tested positive for "properties of marijuana."

Hurd said the money was his and that he had given the car to his acquaintance, a car shop employee, for maintenance and detail work, the complaint said.

"From my understanding, he wasn't the one that was pulled over," Angelo said. "His vehicle was pulled over. He was not the driver. That was never made public. So he was never charged with anything. There was never any record to our knowledge. And it was, from my understanding, a citation, but other than that, there was no other information that was presented to us."

Angelo would not say if the Bears would try to recoup some of the signing bonus. He also gave a terse answer when asked whether the case might affect his own future with the Bears, telling a reporter to "whistle Dixie." Angelo is under contract through 2013.

As for Hurd, receiver Earl Bennett described him as a "guy with high character who just loves to play the game of football, loves to have fun." Bennett also said he doesn't think other players are involved.

"I wouldn't think so," he said. "A lot of guys in this locker room are very high-character guys."

Coach Lovie Smith echoed that sentiment.

"We have a great group of guys," he said. "But sometimes when you're dealing with this many, it's hard to have all the players be a certain way. But you can't let that scar what else we're getting done here. It's always about the team. Every once in a while a guy will go outside what's best for the football team and there are consequences that you deal with. That's how life goes. There are life lessons that are being learned here by our football team."

Greenfield said he wasn't sure whether Hurd would try to get picked up by another team as he fights the drug case.

"Sam's a football player and he wants to play," he said. "Hopefully he'll be playing in the near future with another team."

If not, the attorney said, there are other options.

"Sam's a college grad, Sam's a scholar, Sam's a very, very smart individual," Greenfield said.
